The terms and conditions published on this page shall replace any other terms or conditions, whether or not such terms or conditions are signed by SØLAGEAR.COM. SØLA Technical Clothing Pty Ltd reserves the right to make changes to this site and these terms and conditions at any time. By ordering or registering for an account on SØLAGEAR.COM you grant us the right to add your personal contact information to our database. From time to time we may contact you for marketing purposes. At any time your contact details may be removed form our data base by unsubscribing from our media releases.
Your receipt of an electronic order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. SØLAGEAR.COM reserves the right at any time after receipt of your order to accept or decline your order for any reason. SØLAGEAR.COM reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed must obtain pre-approval with an acceptable method of payment, as established by us. We may require additional verifications or information before accepting any order.
Delivery times provided by SØLA are estimates only. SØLA will not be held accountable for late deliveries or loss or damage relating to late deliveries. It is the responsibility of the customer to ensure a correct address is provided for delivery.
Change of Address
SØLAGEAR.COM cannot be held responsible for an incorrect address being entered on your order.
Address Confirmation is given on the review & buy page in the checkout section of the site. If this is not noticed until after your order is finalised, please contact us immediately.
We will attempt to update any incorrect order details, however some orders cannot be adjusted. In the case that your order is processed and cannot be updated, please refer to our returns and exchange section for more information.
SØLA is not liable for any losses or damages caused by this website or any website linked to or from this website. We reserve the right to refuse any order without giving reason. Upon cancellation of an order we will make all reasonable attempts to contact you using the details provided. All received monies will be refunded using the method received.
If notified before goods have been dispatched, SØLAGEAR.COM can accommodate order cancellations. If items have been shipped, SØLAGEAR.COM reserves the right to refuse order cancellation or charge a cancellation fee should we be able to request the return of the package from our delivery service.
Credit card payments and fraud
SØLAGEAR.COM reserves the right to decline any transaction they believe to be fraudulent or any transaction believed to be using stolen identification or credit card details from an untrustworthy source. SØLA reserves the right to cancel or not fulfill any purchase or refuse refund from an attempted transaction from a fraudulent or untrustworthy source.
We are a seller to end user business and sales shall not be completed for customers with the intent of on-selling the products.
Customs and Duties
Any customs charges or duties payable are the responsibility of the customer.
Refunds & returns policy
We will accept returns based on incorrect sizing if the product is returned 30 days from the time of receiving the goods. Only defective goods or goods under warranty claim will be accepted after 30 days unless by special agreement by a SØLA representative.
All products returned for exchange must be in the following state
- Un-used, unworn, unwashed and undamaged
- All tags and labels still attached
- Unsoiled and unmarked
- In original packaging
- Must be complete and all parts or extra pieces included in return
- Must be accompanied by the sales receipt or invoice
Refunds will not be given if you change your mind or find the item cheaper somewhere else. For other refund conditions see ‘warranty conditions’.
Return shipping costs are at the expense of the customer. SØLA will refund the shipping costs if the return is due to our error or a fault in the product. We recommend sending returns via registered post, as we do not accept responsibility for lost items.
Non-Søla manufactured products – warranty and returns
Where a product being returned is not a SØLA manufactured product and is a 3rd party item, the manufacturers warranty shall apply. SØLA is not responsible for, not can we control another manufacturers terms or policies or time frames. SØLA will assist wherever possible to ensure your product is handled quickly and keep you informed throughout the process.
Warranty on Products
If the product is found to be defective under normal use and proper care within the first 12 months from the date of purchase, SØLA will repair or replace the product at our sole discretion. Examples of product failure are broken zippers, stitching separating or unthreading, buttons unthreading and Velcro separation.
If an identical replacement product is no longer available we will discuss the options with you, to replace with a different product, provide a credit or refund your money etc. Products without a copy of the purchase receipt or invoice will NOT BE COVERED UNDER WARRANTY.
The following damage will not be Covered Under Warranty.
- Fading from sunlight
- Repairs or alterations done by anyone other than SØLA or a SØLA authorized repair facility
- Materials over 12 months (from date of original purchase)
- Thinning of the fabric due to normal wear.
- Any damage such as tearing, ripping, cuts, abrasion, or other damage from the wearing of the product in harsh environments or strenuous activity.
- Any damage to zippers, stitching or buttons due to being torn, pulled or damaged through high stress, abrasion or strenuous activity.
- “Cooking” from clothes dryers or heater.
- Damage due to improper laundering or not following recommended care instructions
Listing errors and Typos
In the event a product is listed at an incorrect price or with incorrect information, we may refuse or cancel any orders placed for that product, whether or not the order has been confirmed and your credit card charged. This clause is for clarification only and is not in limitation of our general rights to refuse to accept orders.
